These Terms of Use or Terms of Service (“Terms”) govern your access to and use of the FinToolbox website located at www.fintoolbox.online (the “Platform”), which is operated by Ziyanda Capital, a division of Ziyanda Investment Enterprises (Pty) Ltd (“we”, “us”, or “our”).

By accessing or using the Platform, you accept and agree to be bound by these Terms.

If you do not agree, you must immediately stop using the Platform.

1. Nature of the Platform

FinToolbox is an online financial insight and calculator toolbox. It provides general‑purpose calculation tools such as home‑loan calculators, business breakeven tools, investment‑growth calculators, compound‑interest illustrations, and downloadable financial‑model templates.

The Platform is informational and educational only and does not constitute financial, tax, investment, legal, or any other regulated professional advice.

You must not rely on the outputs, assumptions, or models as the sole basis for any financial decision.

You are responsible for seeking independent professional advice from qualified financial, tax, or legal advisors before acting on any information obtained from the Platform.

2. No Advisory or Fiduciary Relationship

Accessing or using FinToolbox does not create a client‑advisor, fiduciary, or any other professional relationship between you and Ziyanda Capital or its affiliates.

Ziyanda Capital provides structured finance consultancy services as a separate business line; use of FinToolbox alone does not constitute engagement of those consultancy services.

3. License to Use the Platform

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Platform for your personal or internal business planning purposes.

You may:

- Use the calculator tools and view outputs.
- Download and adapt the provided templates and models for your own use, in accordance with any license notes included with those files.

You may not:

- Reproduce, redistribute, sell, license, or commercially exploit the Platform or its content without our prior written permission.
- Reverse‑engineer, copy, scrape, or extract the underlying logic or data fields of the calculators at scale for use in a competing product or service.
- Use the Platform for illegal, fraudulent, or unlawful purposes.

4. Accuracy and Reliability

The tools and outputs on FinToolbox are based on standard financial formulas and assumptions.

While we strive to provide accurate and up‑to‑date information, formulas and inputs may change over time, and the Platform may contain technical errors or limitations.

We explicitly disclaim all warranties concerning the Platform, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, or suitability for any decision.

Your use of the Platform is at your own risk.

5. Limitation of Liability

To the fullest extent permitted by law, Ziyanda Capital and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with:
- Your use of or inability to use the Platform;
- Any reliance on outputs, assumptions, or models provided by the Platform;
- Any errors, omissions, or inaccuracies in the tools or downloadable templates.

In no event will our aggregate liability exceed the amount you have paid us (if any) for using the Platform in the 12 months preceding the claim.

If you have not paid anything, our liability is limited to zero.

6. User Conduct and Acceptable Use

You agree that you will not:
- Use the Platform to commit or facilitate fraud, money laundering, or other illegal activities.Attempt to gain unauthorised access to our systems, databases, or other users’ accounts.
- Use automated tools (bots, scrapers, etc.) to extract large volumes of output or model data in a way that could harm our systems or infringe on our intellectual property.

We reserve the right to restrict or terminate your access to the Platform if we reasonably believe you are violating these Terms or engaging in abusive or harmful behaviour.

7. Intellectual Property

All content, design, tools, and branding on the Platform (including but not limited to layout, text, graphics, calculators, and downloadable models) are owned by or licensed to Ziyanda Capital, unless otherwise stated. 

Subject to these Terms, you may use and adapt the downloadable templates for internal or personal use, but you may not:

-Claim exclusive ownership of the underlying model structure or logic.

-Resell, relicense, or bundle the templates as part of a commercial product or service without our written consent.

8. Links to Third Parties

The Platform may contain links to third‑party websites or resources. These links are provided for convenience only. We do not control, endorse, or accept responsibility for the content, accuracy, or practices of any third‑party site.

Your use of third‑party sites is at your own risk.

9. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will either:

- Update the “Effective Date” at the top of this page; and/or
-Provide a notice on the Platform or via email (if you have provided contact details).

Your continued use of the Platform after any such change constitutes your acceptance of the updated Terms, to the extent permitted by law.

If you do not agree with the changes, you must stop using the Platform.

10. Governing Law and Disputes

These Terms and any dispute arising from your use of the Platform shall, in the first instance, be interpreted in accordance with the laws of the Republic of South Africa.

Nothing in these Terms limits any rights or remedies you may have under the applicable consumer protection or data‑protection laws in your jurisdiction.

You are encouraged to contact us first to resolve any dispute (via support@fintoolbox.online or privacy@fintoolbox.online).

If we cannot resolve the matter informally, you may lodge a complaint with the relevant supervisory authority or seek recourse through the courts of competent jurisdiction in your country of residence.
